Direction issued by the Commission Dr. Lenin, Member Distt. Vigilance Committee on bonded labourer, Varanasi has sent this complaint alleging that the minor children named in the complaint are being ill-treated and beaten by power loom factory owner. They are being forced to work for a longer time. The owner of the power loom factory is threatening the children and their parents. He has prayed to intervene in the matter and action taken. Copy of the affidavit is also annexed. In response to the conditional summons, a letter dated 1.3.2011 has been received from Distt. Magistrate, Varanasi along with the report received from Addl. Labour Commissioner, UP, Varanasi Range, Varanasi. Perusal of the same reveals that the enquiry team visited the power loom factory on 12.11.2010. At that time no child labour was found working. The question of taking legal action against factory owner thus does not arise. Victim Bashir Ahmed was examined who filed an affidavit of his own stating therein that his sons never worked at the power loom of Hazi Jameel. The complaint was made by him at the instance of certain persons who are jealous of Hazi Jameel. Copy of the affidavit is annexed. The Commission has considered the report. Along with the original complaint the affidavit of victim Bashir Ahmed was annexed. Now along with the report received the affidavit of Bashir Ahmed has been annexed by Distt. Magistrate, Varanasi. In order to come to a just conclusion, Director General (Investigation) is requested to depute an officer of the Commission who should visit the power loom factory owned by Hazi Jameel. The deputed officer shall obtain original affidavits from complainant and Distt. Magistrate, Varanasi who forwarded the copy of affidavit of Bashir Ahmed. He shall also interrogate Bashir Ahmed in order to find out the truth. He shall also get the person identified who identified the complainant before notary public who attested the affidavit and submit the report to the Commission within four weeks.
